(LINTON) - A 70-year-old Linton man accused of pointing a gun at another person was arrested on Tuesday but he posted bond and was released from jail before Christmas.
Billy D. Tuttle was arrested by Greene County Sheriff's Deputies on Monday on charges of intimidation involving drawing or using a deadly weapon, pointing a firearm at another person, battery resulting in bodily injury and criminal trespass.
A warrant was issued for Tuttle's arrest last Monday. He is scheduled to appear in Greene Circuit Court on Jan. 7.
Tuttle is accused of going to a residence on County Road 400 South in the Bloomfield area on November 18. A ruckus ensued and later the victim reported the incident.
According to a lengthy probable cause document, text messages had been exchanged between some family members earlier in the day and Tuttle went to the residence to demand an explanation. The issue stemmed from an alleged incident involving family members that had occurred 30 years earlier.
Witnesses told police that when Tuttle arrived at the residence he was upset, pushed his way in, then an argument started and Tuttle was asked to leave more than once but he refused. They said children were present in the home and they were very frightened by the incident.
According to witnesses, Tuttle reached behind his back, pulled out a pistol, pointed it toward a woman about a foot away from her abdomen, and also told a man that he was going to kill him.
The other adult witness present reportedly grabbed Tuttle from behind and the threatened man got hold of the gun, got it away from Tuttle, but Tuttle grabbed the man's throat. The man then hit Tuttle in the head with the gun, causing Tuttle's head to bleed.
The residents kept the gun; a Sig Sauer P230 9mm semi-automatic. They said there was no bullet in the chamber but the magazine was loaded.
After he was hit, Tuttle allegedly continued to yell and cuss but went outside and then left and went to a hospital for treatment of his injury.
When Tuttle was interviewed, he said he had become disoriented during the incident and didn't know what was going on, but he did not pull a gun on the man and did not threaten to shoot him.
