(BLOOMINGTON) - 34-year-old Thomas Fallis of Bloomington appeared in Monroe Circuit Court Thursday and waived extradition and agreed to return to Weld County Colorado to face a second- degree murder charge handed down by a grand jury on Monday.

Fallis is accused of murdering his 28-year-old wife Ashley Fallis. She died of a gunshot wound at the family's Weld County, Colorado home on New Year's Day in 2012. Her death was initially ruled a suicide

After his wife's death Fallis moved to Bloomington with his three elementary school-aged children in a house in the Winslow Farm subdivision. A Colorado grand jury indicted Thomas Fallis on Monday.

After dropping his three children off at school Tuesday morning, police went to Fallis' home in the 400 block of Laurelwood Drive and arrested Fallis without incident.
