(INDIANAPOLIS) - A Marion County Judge has issued a temporary injunction blocking a Monroe county ordinance limiting noise on the Interstate 69 project.
Judge David Dreyer found the law appears to be on INDOT's side in the dispute. He also cited worker safety and potentially higher construction costs in his ruling against the ordinance.
Monroe County officials adopted the ordinance last month after residents complained about how much noise I-69 construction crews were making at night.
The ordinance limits the noise that can be made between 10 p.m. and 6 a.m. INDOT Spokesman Will Wingfield says the ordinance halted night time construction.
INDOT contractors faced the threat of $7,500 fines for every violation. He added that legislature provides INDOT the sole authority to build and maintain state highways and the county's ordinance is hindering that.
Opponents to the I-69 project say the state should not be concerned with the delay, because it improved the quality of life for those that live near the highway.
