(INDIANAPOLIS) - INDOT is fighting Monroe County’s noise ordinance that has stopped night construction on I-69.
Monroe County officials adopted the ordinance last month after residents complained about how much noise I-69 construction crews were making at night.
The ordinance limits the noise that can be made between 10 p.m. and 6 a.m. INDOT Spokesman Will Wingfield says that ordinance had halted night time construction. He added that legislature provides INDOT the sole authority to build and maintain state highways and the county's ordinance is hindering that.
Opponents to the I-69 project say the state should not be concerned with the delay, because it improved the quality of life for those that live near the highway.
Marion Superior Court Judge David Dryer could rule on a temporary restraining order INDOT filed last week at a hearing this afternoon.
