(BEDFORD) - A Mitchell man was sentenced to five years in prison for hitting two people with a ball bat during an altercation in February.
Judge Michael Robbins sentenced 20-year-old Cody T. Robbins to five years at the Indiana Department of Correction with two years suspended to probation and credit for 80 days already served. (The judge is not related to Cody Robbins.)
Cody Robbins was arrested on Feb. 23 on charges of battery with a deadly weapon and illegal consumption.
Public defender Lorinda Youngcourt wanted Judge Robbins to consider that Robbins had plead guilty to the crime, he was young and was confident Robbins could find a job.
Prosecutor Michelle Woodward recommend a stiffer sentence, saying Robbins had a prior battery arrest in Orange County.
Woodward pointed out the pre-sentence investigation report revealed Cody Robbins was smoking marijuana and drinking a fifth of whiskey on a daily basis.
"The court is concerned about two things," Judge Robbins said. "There's the prior battery offense and the substance abuse problem."
He added that everyone was fortunate that things didn't end up worse, since Robbins was swing a baseball bat.
In addition to his time at the DOC, Cody Robbins was ordered to participate in ADAPT and in the batterers' prevention program. He also was ordered to have no contact wih the two victims and to pay restitution costs.
Judge Robbins rejected the purposeful incarceration program recommendation.
