(MITCHELL) - A tract of land including two buildings is again listed for sale after a mediated settlement in the lawsuit involving CTC Corp., the city of Mitchell and the land where the city has stored salt and sand reserves.
The settlement was reached last week. The agreement itself has not been filed in court, but the attorney for the city of Mitchell Byron Steele says the settlement arrangements are confidential because all the parties involved signed a confidentiality agreement.
The case started after a land survey reported the city did not own a piece of land where it was storing the city's salt and sand reserves. CTC Corp. has operated in Mitchell since the company was incorporated on April 1, 2007.
According to the suit, Owners of CTC Corp., Bryan and Marcy Curl of English, purchased just more than nine acres of land adjacent to their current facility from the estate of Steve Jones on Sept. 3, 2013. The tract included the concrete block area where Mitchell has been storing salt and sand. The city thought it owned the space. When the land survey reported the city didn't own the property, Steele filed a lawsuit to quiet the title on the 1.13 acres the city needed to store its reserves.
The suit included Bryan and Marcy Curl in addition to those who may own or have interest in adjacent parcels. The property, the 9 acres or so has been listed for sale with Kinder Realty.
Mitchell Mayor Gary Pruett says it will be up to the street commissioner to determine where the city will store their salt and sand reserves in the future. For now, the plan is to put what is left behind the city's north side fire department. Pruett added as soon as they learned of the case they dismissed it's part and started moving things from the property months ago.
