(BLOOMINGTON) - The charges have been dismissed without prejudice against a Bloomington man that was arrested in November after a domestic fight in the 500 block North Grant Street.
According to Bloomington Police Sgt. Lucas Tate, the first incident happened on November 2 at 2:49 a.m. when David Atanus got into a verbal agreement that turned physical with a 21-year-old woman.
However when police arrived neither would cooperate and no arrests were made at that time.
Then just after 5 p.m. officers were called a second time and learned that during the first incident Atanus had blocked the woman from leaving, grabbed her by the throat and choked her, pushed her down and kicked her in the side of the head and slapped her.
Tate says the woman had allegedly picked Atanus up from a party and the two had been arguing over sleeping arrangements.
Atanus was arrested and charged with domestic battery resulting in bodily injury and disorderly conduct.
On March 25, 2014 the state asked the court to dismiss the charges against Atanus without prejudice.
