Spierer Attorneys Ask For Protective Order To Keep Evidence Private

(BLOOMINGTON) - Attorneys for the parents of missing Indiana University student Lauren Spierer has asked a federal judge for a protective order to keep some evidence private in the civil negligence lawsuit against two men who were with their daughter the night of her June 2011 disappearance.

Attorneys for Robert and Charlene Spierer say the sensitive and private information will be presented during the discovery process and during the hearing. They claim the protective order is necessary to prevent the harm that would result from the unnecessary public dissemination of private information relating to the parties and nonparties and ongoing criminal investigations.

The protective order also asks that materials deemed "confidential" be destroyed within 30 days after final disposition of the case, including any appeals.

In the civil negligence lawsuit, the Spierer claim Corey Rossman and Jason "Jay" Rosenbaum, then IU students, supplied alcohol to their intoxicated and incapacitated 20-year-old daughter and failed to care for her the night of her disappearance.

Lawyers for Rossman and Rosenbaum argue their clients had no responsibility to care for Spierer and played no role in her disappearance.

In December, U.S. District Court Southern District of Indiana Judge Tanya Walton Pratt dismissed allegations against Michael Beth, another man the Spierers had named in the lawsuit.

Spierer was reportedly last seen about 4:30 a.m. on June 3, 2011, at the intersection of 11th Street and College Avenue. She was walking home alone toward her Smallwood Plaza apartment after a night out at Kilroy's Sports Bar and 5 North Townhomes, where Rossman, Rosenbaum and Beth all lived.
