(BLOOMFIELD) - A Solsberry man accused of breaking a woman's rib in a domestic dispute appeared in Greene Circuit Court Thursday and was charged with domestic battery in the presence of a child and resisting law enforcement.

38-year-old Thomas Foerster, II was arrested when officers responded to a home on North Newark Road on November on Nov. 27 at 10:32 p.m. after emergency crews were called to help an injured woman.

Emergency personnel tended to the woman and called police.

The woman was taken to the trauma center at IU Health Bloomington Hospital for treatment.

When Bloomfield Deputy Marshal Marvin Holt and Greene County Sheriff's Deputy Jeff Payton arrived at the home, they found Foerster hiding under a mattress in a child's bedroom and that he was uncooperative. After a brief physical altercation he was arrested.

Foerster denied arguing or hitting the woman.

However the children in the home told police Foerster was yelling at the woman in an argument over her cell phone and that Foerster pushed her down and would not let her call for help.

The woman told police Foerster had been drinking heavily that day and when she was texting a family member to pick her up because he was getting agitated, he wanted to see her phone and there was an argument. The woman told police he then allegedly pushed her down, got on top of her and held her down for about 10 minutes with a forearm around her collar bone area and a knee on her rib cage area.

On Thursday, he was still in jail and went before Judge Erik Allen who appointed Foerster a public defender and issued a no-contact order protecting the alleged victim.
