Jasonville Man Charged With Breaking His 3-Month-Old Daughter's Arm

(JASONVILLE) - 23-year-old Dustin Lake, of Jasonville man appeared in Greene Circuit Court early Wednesday and was charged with felony neglect of a dependent.

He is accused of breaking his daughter's arm, and failing to get immediate medical attention for the injured baby.

According to the Greene County Daily World, Lake was arrested and booked into the Greene County Jail around 10 p.m. last Thursday.

Jasonville Police Officer James Gadberry was called to the Greene County Hospital after a 3-month-old girl was taken to the hospital to be treated for a broken bone in her left forearm. The break was so bad she had to be taken to Riley Hospital in Indianapolis for treatment.

Before Gadberry interviewed both of the baby's parents, a Department of Child Services caseworker and hospital staff told him x-rays showed that the child's arm had been fractures twice before and the child had a previous broken collarbone and a broken leg. Those injuries had healed.

The mother told police she didn't know how the baby was injured and that the baby seemed fine on Wednesday afternoon. She told police she fed and bathed all three of her children before heading to work, leaving the children in her husband's care.

The mother reportedly said the baby was asleep when she got home from work and she didn't notice anything abnormal when she woke up to feed her around 6 a.m. then put her back to bed.

But when the baby woke up at 9 a.m. last Thursday, she discovered something was wrong with the baby's arm and took her to the hospital.

Lake told police that nothing happened when he was watching the children, but when accused of breaking the child's arm Lake told a different story.

According to a probable cause affidavit, Lake told police he picked the baby up around 11 p.m. and was holding the baby with both hands but when a puppy bit his foot, he reacted and let go of the baby with one hand. Lake alleges the baby slipped out of his other hand and as the baby fell, he grabbed her left arm and the baby swung down and outward and he heard and felt her arm "pop."

When asked why Lake hid the injury and didn't tell his wife what happened, he had no comment.
Police say all three children were taken into custody by DCS. No further information was released regarding the DCS investigation.
