(BEDFORD) - Lawrence Superior Court Judge Michael Robbins sentenced 42-year-old Michael Dustin Moore to 20 years in prison with no time suspended Tuesday.
A jury found Moore found guilty of dealing in a Schedule I controlled substance on May 22, relating to the death of 43-year-old William Alan Napier. Napier died at a home in Mitchell on April 10, 2010.
Moore read from a letter apologizing for his actions.
"I am an addict," Moore read. "I'm truly sorry for the loss you have endured."
Prosecuting Attorney Michelle Woodward argued Moore should receive the maximum penalty of 20 years. While Moore had not committed previous felonies, he has a history of misdemeanor drug charges which began in 1993.
Public defender Lorinda Youngcourt asked for a lesser sentence because Moore was remorseful and was seeking help for his addictions.
However Judge Robbins rejected those mitigating circumstances saying Moore was seeing himself as a victim. He also told Moore he was more focused on himself and other people that night, instead of focusing on the fact that a person died, which also showed a lack of remorse and responsibility.
He also childed Moore for his lack of dedication to his children and family says, his family offered support yet Moore continued to use drugs.
"I find that there's zero remorse on this defendant's part," Robbins said. "He just fears prison and responsibility."
Youngcourt started an appeal process for both the trial conviction and the sentence.
