Myers Ruling For New Trial Could Be Issued By Years End

(MARTINSVILLE) - It will likely be months before Morgan County judge Thomas Gray rules on whether a new trial should be granted to John Myers who was convicted of killing IU Student Jill Behrman, who disappeared during a 2000 bike ride.

Gray has given prosecutors and defense attorneys for Myers II until September 1 to submit legal briefs after what was seven days of testimony since late April ended Thursday.

By law, Judge Gray has 90 days to issue a verdict once he has all the necessary materials in front of him. Gray Could issue his ruling by the end of the calendar year.

Myers was convicted in 2006 of killing 19-year-old Behrman, whose remains were found in a Morgan County field nearly three years after she disappeared.

Myers is serving a 65-year sentence and maintains his original attorney disregarded evidence that could have exonerated him.

Deputy Prosecutor Robert Cline says he is confident that Myers would be convicted again if a retrial was ordered.
