(MITCHELL) - The newly formed Mitchell Plan Commission reviewed and ruled on its first case Tuesday.
John Gass and Jody Jonas asked for permission to put a mobile home on a lot at 504 South. Seventh Street. Gass owns the lot, and Jonas is buying a mobile home on contract from Gass.
Building Commissioner Danny Baker previously turned down the request because it did not meet the city code.
Gass appealed to the commission.
Jonas told the commission she is interested in buying the lot, so she wants to move the mobile to that property rather than putting it in another mobile home park.
Plan commission member Mark Brothers noted the mobile home is 60 feet long. At that length, he said, the mobile home would be beyond the setback lines spelled out in the code.
In the end, board members voted unanimously to reject the request. All seven members -- Vicky Schlegel, Mark Bryant, Linda Greene, Nancy Miller, Matt England, Ron Ellis and Brothers -- were at the meeting.
At the group's inaugural meeting earlier this month, city attorney Byron Steele outlined the procedures for processing cases. If the plan commission rules against the property owner, as it did Tuesday, the property owner has the right to take it to the board of zoning appeals. That board currently consists of Greene and Bryant, but Mayor Gary Pruett is still working on making additional appointments to the board. If the request is denied by the board of zoning appeals, Steele explained, the applicant can pursue the situation in court.
