(LINTON) - Anthony J. “Tony” Niebrugge’s been charged with a trio of misdemeanors. Police say he was found sleeping in a vehicle in the parking lot of White River Valley High School early last Monday morning, parked in a spot that disrupted the unloading of students off the buses.
Anna Rochelle of the Greene County Daily World reports that 43-year-old Niebrugge, of Linton, is facing three counts: Resisting law enforcement, a class A misdemeanor; refusal to aid an officer, a class B misdemeanor; and public intoxication, a class B misdemeanor.
He was arrested by Greene County Sheriff's Deputy Dustin Cain who was dispatched to the school in Switz City after a janitor called in to report a man appeared to be asleep inside an SUV that was sitting in the south parking lot of the junior-senior high school.
Cain said when he arrived, he recognized Niebrugge and knocked on the passenger side window and Niebrugge woke up. Cain said he asked Niebrugge why he was parked at the school and Niebrugge said he was just sleeping.
He continued to ask Niebrugge questions and Niebrugge allegedly said he was there to work with a scaffolding company but school officials said no construction requiring scaffolding was going on.
Then GCSD Det. George Dallaire arrived on the scene and asked more questions but Cain said Niebrugge refused to answer.
According to a probable cause affidavit prepared by Cain, Dallaire instructed Niebrugge four times to exit the vehicle but Niebrugge refused. When Dallaire grabbed his wrist and attempted to remove him from the vehicle, Niebrugge allegedly pulled away and leaned into the center of the vehicle.
Niebrugge was struck with a Taser, physically removed from the vehicle, then placed in handcuffs.
The officers reported they thought Niebrugge was intoxicated and he had an uncooperative attitude. They say his refusal to cooperate created an unsafe situation for the students being unloaded off of the buses because he was parked in the unloading zone.
A search warrant was approved to collect blood and Niebrugge was transported to Greene County General Hospital for a blood draw. Samples have been sent off to the ISP lab for toxicology testing.
Niebrugge was booked into the Greene County Jail then released later the same day after he posted $200 cash -- 10 percent of a $2,000 bond. He appeared in Greene Superior Court Monday afternoon for an initial hearing.
