(BEDFORD) - A Grand Jury convened this morning in Superior Court I.
Judge Michael Robbins is presiding.
Grand jury proceedings are conducted in secret, and the courtroom where one takes place is always closed to the public.
Judge Robbins says a subpoena has been issued to the target witness, but no other information about the proceedings or witnesses would be made public.
The name of the target witness has not been released. Once the grand jury has concluded, the court or prosecutor will release information about whether any indictments were issued.
Under Indiana statute, "grand jury proceedings shall be kept secret, and no person present during a grand jury proceeding may, except in the lawful discharge of his duties or upon written order of the court impaneling the jury or the court trying the case on indictment presented by the grand jury, disclose: (1) the nature or substance of any grand jury testimony; or (2) any decision, result, or other matter attending the grand jury proceedings. However, any court may require any person present during a proceeding to disclose the testimony of a witness as direct evidence in a prosecution for perjury." IC 35-34-2-4(1).
Speculation is to decide if charges will be filed against a man who was involved in a fatal stabbing in May.
According to Bedford Police Chief Dennis Parsley, at the time of the stabbing, the two men got into a fight just before 5 a.m. May 18 during a verbal confrontation in the parking lot at Rusty's West End Steak & Lounge, on Bundy Lane, just west of the bar entrance. The bar was closed when the incident happened.
During that fight 46-year-old Michael Holt was stabbed one time in the chest and died instantly at the scene. Parsley says, the man who stabbed Holt, also suffered injuries and was taken to IU Health Bedford Hospital where he was treated and released.
Police and prosecutors have refused to release details about the fight, including the name of the man who stabbed Holt.
Two weeks after the incident, the Bedford Police Department submitted the case to the Lawrence County Prosecutor's office.
And toward the end of September, the prosecutor's office received the lab results in the case.
Although the man's name is allegedly known within the community, and there is speculation he had acted in self-defense, officials have neither confirmed nor denied any of this.
