Man Sentenced To 55 Years For Double Shooting

(BLOOMFIELD) -35-year-old Timothy Kean, of Sullivan was sentenced to a 55-year prison sentence in Sullivan Superior Court on Friday morning in connection with a double-shooting incident in the parking lot of the Uptown Tavern at Dugger last March.

Nick Schneider, of the Greene County Daily World reports, Kean, had entered a guilty plea to two counts of attempted murder as part of a negotiated plea agreement.

Superior Court Judge Robert Springer sentenced him to 30 years in Count 1, with credit given for 300 days served in the county jail. Kean received a 25 year sentence in count 2 and five year's probation.

The sentences will be served consecutively - meaning he will have to complete the executed part of the Count 1 sentencing before his sentence begins on Count 2.

Kean entered a guilty plea to shooting Jasonville resident Patrick Ruff and Leighann Lovelace, of Linton. Ruff, who was shot in the head, was the most seriously injured and is now confined to a wheelchair and is unable to talk.

A third count of attempted murder was dropped by the prosecution as part of the plea agreement involving the attempting shooting of James Gardner, of Elnora.

A probable cause affidavit filed by Indiana State Police Det. T.C. Hanks shows the shootings happened in a gravel parking lot south of Main St. and east of Second St. -- next to the Uptown Tavern in Dugger.

Ruff and Lovelace were both shot in the tavern's parking lot.

A witness told police he was walking out of the bar about 3:30 a.m. and heard a loud bang. He then heard a second shot and saw James B. Gardner's truck windshield getting shot as he was driving down the street, according to the affidavit.

Gardner immediately jumped out of his truck and confronted Kean, the shooter.
The witness told police that Kean "raised the gun at Gardner, but the gun didn't do anything. Either because of malfunction or the shell not being ejected."

The male witness said Kean then left in his truck with Gardner following him in his truck. The two allegedly got into a fight at a residence located at 1024 South County Road 600E.
Kean will begin his Department of Correction sentence immediately.
