(BLOOMFIELD) - Criminal charges have been filed in Greene Superior Court against Lyons Town Marshal Ronald Sparks.

Special Prosecutor Barry Brown, of Bloomington, filed two preliminary counts against sparks on Friday morning.

The Greene County Daily World reports, Sparks, who has been employed by the town of Lyons since 2004, will be charged with criminal confinement and battery.

Early Friday evening, Sparks was booked in to the Greene County Jail then released after posting ten percent cash of a $4,500 bond. No initial hearing date was set.

The charges stem from an alleged November. 2, incident at the home of a Lyons woman.

According Indiana State Police Trooper Richard Klun there was a verbal argument at the home that turned physical. Det. Smith says both Sparks and victim had been drinking.

During the altercation Sparks allegedly grabbed the woman's arm and dragged her across the floor. He then held her to the floor by allegedly pressing his forearm against her neck.

Klun says Spark's did not deny the allegations, but rather stated he did not remember what happened.

After getting away from Sparks, he allegedly would not let the woman leave the home and that is when she called 911.

According to court records, Sparks and the woman were given a portable breath tests. Sparks registered .158 percent - nearly twice the legal limit. The woman blew a .032 percent.

The Lyons town council meet in an executive session Nov. 27 to discuss the alleged "misconduct" against the town marshal, but no action was taken against Sparks and he remains on active duty.
