Last updated on Monday, February 25, 2013

(BLOOMINGTON) - A police officer checking on a station wagon with a flat tire arrested a Bloomington woman on preliminary felony charges of operating a vehicle while intoxicated and neglect of a dependent.

Abby Tonsing of the Herald-Times reports that the woman's 4-year-old son was in the back seat of the car, police report.

Alison Leigh Amschler, 32, was booked into the Monroe County Jail at 4:43 p.m. Thursday and bonded out of jail Friday morning after posting a $705 bond.

An off-duty officer saw a 1997 green Subaru Legacy with a flat front tire just after 2 p.m. Thursday in the area of East First and South Washington streets. This off-duty officer called officer Justin Gough to assist, Bloomington police Sgt. Jeff Canada said.

When Gough approached the station wagon, Amschler told him, "Do not take me to jail, please," according to the police report on the case. Gough noted in the report he could smell alcohol. He also saw a 4-year-old boy sitting in a booster seat in the back of the station wagon, but the child was not properly restrained in the seat.

Amschler refused to take field sobriety tests, telling the officer, "I will not pass them," according to the police report. Police obtained a search warrant to have her blood drawn for toxicology tests at the hospital.

The child was given to the custody of his grandfather, Canada said.
