(BLOOMFIELD) - 33-year-old Thomas Moore, of Springville, is facing seven charges after he allegedly violated a protective order, injured another man, threatened to kill three officers and did not cooperate with police when he was arrested.
The Greene County Daily World reports that Moore was charged in Greene Circuit Court Wednesday with: Battery resulting in bodily injury, a class A misdemeanor; battery resulting in bodily injury with a prior conviction involving the same victim, a class D felony; invasion of privacy - violation of a no-contact order as a condition of probation, a class A misdemeanor; three counts of intimidation involving a threat communicated to a law enforcement officer, all class D felonies; and resisting law enforcement, a class A misdemeanor.
After Moore was taken to the jail, he was then transported to Greene County General Hospital because he was bleeding from the nose and emergency personnel from the Greene County Ambulance Service told police one of his pupil's was not reacting to light which might indicate a possible concussion.
According to a probable cause affidavit, a doctor in the emergency room advised officers that Moore had a blood-alcohol concentration of .312 and was on a form of "bath salts."
Police arrested Moore after an incident on Saturday when the Greene County Sheriff's Department received a call from a woman saying her two sons were fighting. She told police one of her son's Moore might kill his brother.
Deputies Jeffrey Brown and James O'Malley and Indiana State Police Trooper Richard Klun went to the woman's home on Blue Sky North. Police there was a"no contact" between the two men. Police say, Moore was prohibited from having contact with his brother due to a previous incident where Moore stabbed him with a knife. Moore was convicted of battery with a deadly weapon in that incident in Owen Circuit Court.
When police arrived they found a back room in disarray and blood all over the place. Moore's brother had suffered a possible broken hand from fighting with Moore and Moore was bleeding from his nose.
Moore was arrested for violating the protective order.
As police were taking to the police car, Moore allegedly tried to pull away causing Moore and the officers to slip on the snow and ice. Moore then began kicking the bumper of Deputy Brown's police car, damaged it. Moore continued to struggle with police and officers had to put Moore into a "snow drift" a couple of times, before officers could get leg shackles on Moore and him into the vehicle.
During the ride to the jail, Brown says Moore refusal to sit up or sit still and was screaming, cussing, yelling and kicking. According to the probable cause affidavit, one deputy drove the vehicle and another had to ride in the front seat facing backwards to keep the situation under control.
Then when Moore was taken to the hospital he continued to resist officers and hospital staff. Moore was treated and monitored for four hours before being returned to the jail.
Moore attended his initial hearing on Wednesday by video conference from the jail. A public defender was appointed to represent Moore, a trial date was set April 30 and Moore's bond was set at $9,000 surety or ten percent cash.
