(BROWNSTOWN) - According to a probable cause affidavit, 62-year-old Robert Cross, of Seymour, is accused of stabbing his brother.

Robert Lee Cross told police his brother, 65-year-old Melvin Cross, told him last Friday that he had to leave Melvin Cross' home because of his drinking problem. So he attacked out of fear and anger of being turned out into the cold with no place to go.

Jackson Circuit Senior Judge Bill Vance entered a not-guilty plea on behalf of Robert Cross during his initial hearing Wednesday. Vance set a trial date for June 18.

According to deputies with the Jackson County Sheriff's Department Melvin Cross was stabbed several times in the chest and was rushed to Schneck Medical Center and then flown to St. Vincent Hospital in Indianapolis where he underwent surgery and is doing well, according to family members.

Police arrested his brother, Robert Cross, in the 750 block of North US Hwy. 31 and charged him with attempted murder and criminal recklessness with a weapon.
