(BLOOMFIELD) - The Daviess County man who punched a Dugger man on the side of the face, causing him to fall and hit his head on the floor at Dugger’s Uptown Tavern, is going to prison.
Nick Schneider of the Greene County Daily World reports that James Bradley Gardner, 24, of Elnora, was sentenced to eight years with the Indiana Department of Correction last Friday in Sullivan Superior Court on a single count of involuntary manslaughter -- a class C felony.
Gardner pleaded guilty to the Sept. 1 incident that caused the death of 51-year-old Richard D. Pigg.
Under terms of the plea agreement, which were approved by Judge Robert Springer, Gardner received an eight-year prison term with credit for 128 days served in jail. He was also fined $25 and court costs.
Pigg died on the evening of Sept. 1 at IU Health Methodist Hospital in Indianapolis. An autopsy revealed he died of blunt force trauma to the head, according to court records.
The investigation revealed a verbal altercation allegedly initiated between Pigg and Gardner inside the bar. The verbal argument escalated and Gardner allegedly punched Pigg in the face with his closed right fist. Pigg fell to the floor and landed near a pool table, according to the probable cause affidavit filed in the case.
The autopsy showed that Pigg was "knocked unconscious by the punch" and fell straight to the floor unsupported.
