(MARTINSVILLE) - 22-year-old Nick Ferris and his wife 22-year-old Brooklyn, of Martinsville, were sentenced Tuesday to 30 days in jail and 335 days probation for allowing two of their dogs to starve to death at their home.

Nick Ferris and his wife Brooklyn told Morgan County Superior Court III Judge Jane Craney they had no excuses for their inattention to their dogs. They did say that working two jobs and caring for a new baby created stress for them. They each pleaded guilty to one count of cruelty to an animal. In return, the state dismissed two additional cruelty counts that had been filed against both of them.

With "good time" credit each will serve 14 days in jail.. In addition, the judge ordered they have no more than one dog while on probation. The couple was able to get one of their dogs back.

The judge staggered the sentences for the couple because they have a child younger than 2. Brooklyn Ferris was ordered to begin serving her sentence immediately. She will be released Dec. 17. At that time, Nick Ferris will begin serving his sentence.

According to the probable cause affidavit, between April 1 and May 15, the dogs, called "Brady" and "BJ" were confined in a kennel at the rental home the couple had lived in.

Both were reportedly in the process of moving out. While they admitted to having food and water in the home, and being there at least twice a week, both said they neglected to take care of the dogs.

The couple had five dogs, two that were in the kennel, two that were in the home and one that was chained up outside. The dog chained up outside got away and was picked up by the humane society.
