(BROWNSTOWN) - A Kentucky truck driver faces a reckless homicide charge in connection with a wreck that left a state highway worker dead.
Robert Allen Burger, 51, of Louisville, Ky., turned himself in at the Jackson County Jail in Brownstown at 4:29 p.m. Tuesday.
Burger is charged with reckless homicide a Class C felony in the death of 56-year-old Gregory Lawdermilt of North Vernon. If found guilty he could face two to eight years in prison upon conviction.
A report from the Indiana State Police states that Burger's semitrailer rig struck the rear of a parked Dodge Stratus driven by Lawdermilt.
Lawdermilt had stopped to help with a wreck that occurred just before 9:30 a.m. Dec. 8 in the southbound lanes of Interstate 65 about 3.5 miles north of Seymour, according to court records.
Lawdermilt and another motorist had put out triangle safety markers to warn other motorists about the first wreck. Lawdermilt then went back and got into his vehicle, which then was hit by Burger's 2007 Freightliner, according to a news release from Indiana Department of Transportation.
Both vehicles skidded into the median and burst into flames, police said.
Authorities say Burger falsified his logbook and had been driving at least 22 hours of the previous 30. That's a violation of federal regulations.
Burger has been released on bond from the Jackson County Jail.
