(BLOOMFIELD) - A Sullivan man is facing charges in Greene Superior Court following erratic driving near Bloomfield.
Sabrina Westfall of the Greene County Daily World reports that Greene County Sheriff's Department Deputy Bobby Pierce wrote in a probable cause affidavit he witnessed a vehicle traveling westbound on State Road 54 on Nov. 11, and observed the vehicle cross the white and yellow lines multiple times.
"The vehicle was over halfway into the opposite lane of traffic and traveled in that lane for several feet," Pierce wrote in the probable cause.
The driver identified himself as Dustin L. Brashier, 29, and informed the officer he did not have a driver's license, and was only driving because the passenger could not drive well in the dark.
Pierce noted in the probable cause the driver and passenger appeared to have slurred speech and bloodshot eyes.
When Pierce informed Brashier he was pulling him over regarding the travel in the wrong lane, Brashier said he was trying to find the passenger's cell phone and taking a drink.
"When asked for identification Dustin said he didn't have any and began reaching under his seat," Pierce said, noting at this time he asked Brashier to exit the vehicle.
Pierce said he noticed a burnt white hand rolled cigarette next to the seat, and asked Brashier if he was under the influence of any drugs.
Brashier said he was not under the influence, but consented to the search of the vehicle.
Pierce located the hand rolled cigarette, which he noted smelled like "burnt synthetic cannabinoids," as well as a product called "Bizzaro" he referred to as a "synthetic cannabinoids." He also found a white, rectangular pill under the seat identified by the Indiana Poison Control as Alprazolam, a schedule IV controlled substance.
Brashier informed the officer he did not believe the Bizzaro was illegal to have in his possession.
"I explained to Dustin even if the substance was legal, he should not be driving while under the influence of it. Dustin agreed," Pierce wrote.
Brashier then stated the Alprazolam belonged to the passenger, who must have dropped it, but the passenger denied the claim. Brashier later admitted the pill was his, and he had tossed the pill under the seat.
Brashier was arrested and taken to the Greene County Jail for possession of a schedule I, II, III or IV controlled substance, a class D felony; and driving while suspended with a prior conviction, a class A misdemeanor.
Brashier's initial hearing was Nov. 14 at 3 p.m., and his pretrial conference is scheduled for Jan. 7 at 2:30 p.m.
