(BLOOMFIELD) - A Bloomfield man has been arrested and charged with battery resulting in bodily injury to a minor.
Nick Schneider, of the Greene County Daily World reports, Billie J. Vester, 43, who lives on North Washington Street, allegedly hit a 12-year-old boy in the back of the head twice and kicked him repeatedly when the boy wanted to play a video game.
Charges were filed Wednesday in Greene Superior Court.
He is preliminarily charged with battery resulting in bodily injury-victim is less than 14 years of age and defendant is more than 18 years old -- a class D felony.
He will appear for an initial hearing at 9:30 a.m. on Aug. 17 where he'll be formally charged.
According to a probable cause affidavit filed by Bloomfield Deputy Town Marshal Marvin C. Holt, Vester allegedly had been drinking and had passed out on the evening of Aug. 4 at his residence.
Allegedly the boy approached Vester and asked if he played the X-Box and the sleepy defendant said "yes."
A short time later Vester allegedly woke up and he became upset and slapped the boy in the back of the head with an open hand. The boy dropped to the floor, according to the probable cause affidavit.
Vester then allegedly began to kick the boy in the legs about 10 times as the boy attempted to crawl away, but he was forced by the kicking into his bedroom.
When interviewed by Holt, Vester said he did smack the boy on the back of the head "to get his attention."
"Billie (Vester) said he meant to swat him in the butt. Billie said that he might have kicked him in the leg. Billie said he didn't mean to harm him...," Holt wrote in the probable cause affidavit.
