(BLOOMINGTON) - Bloomington pain doctor Kamal Tiwari’s sentencing hearing set for Tuesday afternoon has been postponed until Sept. 18.
The 60-year-old Bloomington physician, pleaded guilty this spring to two of the 13 federal charges against him. He faces a maximum prison term of six and a half years and will be on parole for three years after his release.
Tiwari he admitted his wrongdoing and accepted responsibility for his crime allowing for a reduced sentence.
According to the plea deal, Tiwari must repay $1.3 million, the income investigators say Tiwari pocketed from the fraud for which he pleaded guilty.
Tiwari will forfeit property that was purchased from proceeds of the offenses to settle the debt. That includes his family's million-dollar Hyde Park home, a $3 million beach house on Hilton Head Island, S.C., which he purchased in 1994; and $50,000 in cash paid into a $2 million life insurance policy.
He also must surrender the funds from two retirement accounts. The repayment arrangements recently were finalized in court.
Tiwari gave up his medical license in the fall of 2010 after investigators charged him with defrauding insurance providers, including Medicaid and Medicare, of millions of dollars and overprescribing narcotic drugs to addicted patients.
According to a probable cause affidavit Tiwari implanted pain pumps and performed pain-relief procedures "for the purpose of increasing the revenue for his medical practice and not for a legitimate medical purpose."
Tiwari was an anesthesiologist in Bloomington who established several pain management clinics around the state. He also was a founder of Monroe Hospital.
