(LINTON) - A Spencer man, who attempted to evade a pursing Linton police officer by driving more than 90 miles per hour earlier this month, now faces a felony charge of being a habitual traffic violator for the second time.

Nick Schneider, of the Daily Daily World reports, Anthony W. Sowders, 41, was formally charged Tuesday in Greene Superior Court by videoconference from the Greene County Jail with operating a vehicle as a habitual traffic offender - a class D felony.

Superior Court Judge Dena Martin set a pre-trial conference for 2:30 p.m. on July 2 and appointed Greene County Public Defender Alan Baughman to represent Sowders in upcoming court appearances.

Baughman filed a motion to reduce Sowders' $4,000 bond.

On Wednesday, Judge Martin denied the motion and Sowders remains incarcerated in the Greene County Jail at Bloomfield.

Sowders was arrested during the early morning hours of May 13 after Linton City Police Officer Brock Garrison noticed his 1998 Buick Century traveling east on State Road 54 near the intersection with County Road 800W at a high rate of speed.

Initially, Sowders' vehicle was clocked at 73 mph in a 55 mph zone. As the car approached County Road 100N, it rapidly sped up to a radar locked speed of 93 mph, according to the probable cause affidavit filed with the court.

Sowders' car then turned onto County Road 100N off of State Road 54 and as it approached State Road 67, LPD officer Garrison activated his emergency lights.
"The car pulled over and then started to leave. The car eventually stopped in a parking lot." Garrison wrote in the probable cause affidavit.

A check of Indiana Bureau of Motor Vehicle records showed that Sowders' driving privileges were suspended as a habitual traffic violator from Aug. 29, 2007 until Aug. 29, 2012.
