(DUBOIS COUNTY) - A settlement has reportedly been reached in the lawsuit filed by former assistant Dubois County custodian Katherine “Kathy” Kern against the county.
A dismissal with prejudice was signed earlier this week in U. S. District Court in Evansville.
An order of dismissal with prejudice means that the case against Dubois County has been terminated and cannot be refiled.
Kern reportedly will receive a financial settlement from the county. The amount has not been and according to county attorney Art Nordhoff is not public record.
The money is being paid for from a public official's liability insurance policy of the county's.
Kern sued the county Oct. 19, 2011, alleging the county sexually discriminated against her in hiring Scott Hopf as head custodian in 2009 when Bill Loveall retired from the position.
Kern asserted in her lawsuit that she was more qualified for the position than Hopf. She had been employed by the county since September 2000.
The Dubois County Commissioners fired Kern on Jan. 13 of this year, at Hopf's recommendation. Hopf claimed Kern routinely failed to follow a work schedule he set for her because of a second job she held. He says the two were never able to work out a mutually beneficial work schedule.
