(WORTHINGTON) - A domestic dispute Sunday evening at a public fishing site on the White River near Worthington resulted in the arrest of a rural Martinsville man on a pair of drug charges and violation of protective order.
Tommy J. Gregory, 33, is charged with possession of a Schedule I, II, III or IV controlled substance - a class D felony; unlawful possession of or use of a legend drug or precursor - a class D felony; and invasion of privacy for allegedly violating a no contact protective order - a class A misdemeanor.
Nick Schneider, of the Greene County Daily World reports, Gregory made an initial appearance in Greene Superior Court on Tuesday and Judge Dena
Martin set a 2:30 p.m., June 11 pre-trial conference.
Bond was set at $30,000 with 10 percent allowed.
The court also set an April 24 pre-trial conference for Gregory in a misdemeanor invasion of privacy case that was filed Oct. 25, 2011.
According to a probable cause affidavit filed by Worthington Deputy Town Marshal Randy Raney, he was dispatched to a site near the White River Bridge on State Road 157 about 7:35 p.m. on Sunday.
When he arrived, a female was on the ground at the left front fender of a 1999 Dodge Caravan lying on her back crying. A male, identified as Gregory, ran north from the parking lot along the river as Raney approached in his fully marked police cruiser.
Raney went on foot pursuing Gregory, who was trying to get down to the river's edge.
The suspect stopped when officer Raney yelled at him, pulled his Tazer and ordered him to stop, according to a probable cause affidavit filed with the court.
Gregory was observed with blood running down his nose and scrapes on his forehead, Raney wrote in the affidavit.
Indiana State Police Trooper Richard Klun and Greene County Sheriff's Department Deputy Rick Marques arrived to assist.
The female told police that she and Gregory were homeless and were trying to find a place to stay and had engaged in an argument.
Trooper Klun stated that he was familiar with Gregory and had recently arrested him for invasion of privacy on a protective order with the female.
A computer records check confirmed that the protective order issued by the Vigo County Superior Court was still active. The protective order had been issued as a condition of a pre-trial release and prohibits him from contacting the female, Raney wrote in the affidavit.
Gregory was placed in the police vehicle and to his right was a plastic bag containing make-up and assorted jewelry. To his right, Raney observed a prescription bottle with no label that contained 11 yellow pills identified as Hydrocodone, a Schedule III controlled substance.
Inside the jewelry bag, Raney found a prescription bottle that contained Gregory's name for Hydrocodone/APAP 5-500mg. However, the pills did not match the strength of the pills found in the unmarked bottle that was in Gregory's possession. Also inside the marked prescription bottle was five yellow-colored capsules identified as Gabapentin 300 mg and one 600 mg. Gabapentin tablet -- all classified as legend drugs.
