(DUGGER) - Indiana State Police say the shooting in a parking lot near the Uptown Tavern, in Dugger, was sparked after a domestic dispute turned violent.
35-year-old Timothy Kean, of Sullivan, was charged Tuesday with three counts of attempted murder. He is accused of shooting 39-year-old Patrick Ruff, of Jasonville and 31-year-old LeighAnn Lovelace, of Linton and firing a shotgun into a truck driven by 24-year-old James Gardner, of Elnora.
Ruff, who was shot in the parking lot, remains in the intensive care unit at IU Health Methodist Hospital in Indianapolis in critical condition. He's in a coma and is unresponsive after sustaining a blast from a shotgun to the head and shoulder.
Lovelace was shot as she ran back into the tavern to get help. She was released from the hospital Monday. The shot fired into Gardner's truck, as he was driving by the bar, didn't injury him.
According to a probably cause affidavit, witnesses told police, Gardner immediately jumped out of his truck and confronted Kean. Kean then attempted to shot Gardner, but the gun malfunctioned. Kean then got into his truck and Gardner followed him where the two allegedly got into a fight at Kean's home on South County Road 600 East.
Police say Lovelace dates Kean's bother Andy and that sparked the shooting.
Andy Kean was arrested earlier that night for operating a vehicle while intoxicated and was taken to jail. Tim Kean was attempting to get bail money for his brother when he discovered Lovelace with Ruff.
Police say Tim Kean, believed Lovelace was "stepping out on his brother."
Tim told police he was upset because he went to the bar to get bail money and found Ruff driving his brother's truck and Lovelace with him. Lovelace had told Andy Kean that she was having a "girl's night out."
Tim told police he was so enraged at seeing Ruff with Lovelace and in his brother's truck that he went back home, got a shotgun and returned to the bar with the intentions of killing Ruff. Tim admitted to police he shot Ruff, one time, but does not remember shooting Lovelace or shooting Gardner's truck. He did remember Gardner following him home and getting beat up by Gardner.
