(BLOOMFIELD) - The mother of a Linton-Stockton Elementary School student is claiming negligence by the school caused her son to sustain an injury to his hand.
Sabrina Westfall of Greene County Daily World reports that Jennifer Phillips and her son filed a civil tort suit Monday in Greene Circuit that names the Linton-Stockton School Corporation, Linton-Stockton Elementary School and Superintendent Nick Karazsia as defendants.
Phillips and the co-defendant, her son, are asking for a jury trial to adequately compensate her for injures and damages, for the costs of the court action and for all other just and proper relief, according to the suit filed by Tony B. Manns, of the Terre Haute law firm of Wagner, Crawford and Gambill.
According to a complaint, the elementary student was allegedly sitting on the gym floor May 20, 2011 during a game of kickball when his hand was stepped on.
The plaintiff alleges the incident was the fault of the defendants due to negligence in maintaining a reasonably safe condition for its students, and failing to properly monitor and supervise the students.
It is alleged the plaintiff's minor son sustained temporary and permanent injuries; has incurred medical expenses, and may continue to incur medical expenses; as well as sustained, and may continue to sustain pain and suffering of the body and mind.
No court date has been set.
