13-Year-Old Discovered Body Of His Mother

(WASHINGTON) - A Daviess County jury of 9 men and 5 women will continue to hear testimony this morning in the murder trial of Derek Williams. (Washington Times)

Daviess County Superior Court Judge David Sobecki is presiding. Derek Williams is charged in the February 4, 2011 shooting death of his 42-year-old wife, Kim.

Defense attorney Tonya Shaw told the jury she won't try to pretend Williams didn't hold the gun, a .40-caliber Glock, and that the death didn't happen. But she added the state had to prove that Derek knowingly and intentionally killed his wife.

Prosecuting attorney Dan Murrie told the jury Kim died from two gunshot wounds to the head - the first bullet was to kill her, the second bullet was to make sure she was dead and the third bullet he saved for himself.

The prosecutor painted a picture of a normal evening, the couple's two son going to bed around 9 p.m.

The 13-year-old woke around 1 a.m. when he heard his mom crying and saying "why are you doing this?" he then heard the gun shots and found both parents on the bedroom floor. He tried to use the house phone, but it had been unplugged. He then got his mom's cell phone from her purse, grabbed his little brother and locked themselves in their bedroom and dialed 911.

Following that, Murrie described the scene the deputies found when they arrived at the Williams residence. He said Derek Williams was hiding around the corners in the house and then came out in a shooter's stance, pointing as if he had a gun and saying "bang, bang." A deputy realized Williams was unarmed, but before he had time to holster his weapon, according to Murrie, Williams attacked the deputy and went for his gun.

The prosecution claims Derek killed his wife because she had filed for divorce.

Testimony resumes today.
