Parents Seek Damages After Child Injured

(BLOOMFIELD) - Parents from Henry County are seeking damages from a rural Bloomfield Church Camp, after their daughter was hurt in an ATV accident there, last summer. (GC DAILY WORLD)

The parents are seeking unspecified compensation for direct and punitive damages. No hearing date has been set.

James and Emily Wright, the parents of Micah Kelly, a minor, filed a four count, 11-page suit against Adventures in Mission, Inc., Beechwood Lake Christian Camp, Camp Director Richard Anderson, all of rural Bloomfield, and camp employee Charles Coyne, of Wabash.

The suit was filed by Darren S. Stewart, from the Carmel law firm of Stewart & Stewart.

In Count I, the suit alleges that on the morning of July 29, 2011, defendant Charles Coyne was operating an all-terrain vehicle on the Beechwood Lake property near Tulip and "recklessly" drove toward Micah Kelly in attempt to "startle and/or scare her." Coyne is alleged to have turned the ATV causing it to run over Kelly.

The suit alleges that Coyne was negligent by operating the ATV at an unreasonable speed causing Kelly to sustain serious injuries and medical expenses and other costs by her parents.

In Count II, the suit alleges that Coyne was an employee at the camp and that made the owners negligent for his action.

Count III alleges that the camp owners did not exercise reasonable care to insure it was in a reasonable safe condition because it did not prevent an employee from operating an ATV near camp patrons or near walkways or paths used by patrons.
Count IV alleges that the camp owners and director were negligent in allowing the accident to happen - saying Coyne was "incompetent" to operate the ATV, but nonetheless was allowed to do so.
