(BEDFORD) - When asked by Lawrence County Deputy Prosecutor Jody Donaldson if Donnie Lovell thought his half-brother Kenneth Tipton intended to harm police officer Lovell said “No”.
Lovell testified in Tipton's trial Monday in Lawrence County Superior Court II.
Tipton is charged with attempted murder, criminal recklessness with a deadly weapon and dealing marijuana.
He is being represented by local attorney Scott Callahan.
Tipton is accused of firing a long rifle at police on Aug. 16, 2009, when they went to Tipton's home to arrest him for battering his wife.
Lovell was at the home and opened the door to police, but refused to let them enter because they didn't have a warrant. Lovell told police Tipton was not at the home. Bedford Police Officer Justin Dodd entered anyway while BPD Sgt. Greg Hagan was at the back door.
Hagan testified that he went to the front door and entered after notifying Dodd that he saw Tipton in the house.
After placing Lovell in handcuffs and sitting him on the couch, Tipton allegedly entered from the hallway with a rifle and fired a shot.
Police ran from the house and took cover. Tipton is alleged to have fired two more shots at officers. Tipton then fired several more shots at police. The shots damaged a police cruiser, neighbor's homes, broke windows, punctured siding and sent pellets into the home.
Tipton surrendered after police produced a fake letter guaranteeing Tipton he would not be prosecuted for firing the gun.
Testimony is schedule to continue today (Tuesday).
