(BEDFORD) - Adam Mullis testified in Lawrence County Superior Court II Wednesday that his house had multiple holes in the siding and two broken windows after shots were fired on Aug. 16, 2009.
A shot gun pellet was found in the back of his couch and his wife's car has two flat tires and pellet makings.
Mullis and his wife were not home when the stand off between police and Kenneth Tipton happened on Aug. 16, 2009.
Tipton is standing trial on attempted murder, criminal recklessness and dealing marijuana charges. He is accused of firing a long rifle at police when they went to Tipton's home at 2418 J St. to arrest him for battering his wife. Attorney Scott Callahan is representing Tipton.
Devin Chumley testified he was sitting in his truck and talking to a friend when police arrived at Tipton's house. He then said that saw officers running from the house and heard the first shot. Chumley says he jumped out of his truck and ran behind a neighbors house for cover.
A ballistic expert from the Indiana State Police lab, Bedford Police Department Det. Sgt. Brandon Woodard and Maj. Kevin Jones also testified on Wednesday.
With the jury out of the court room, Attorney Scott Callahan asked Bedford Police Detective Sgt. Brandon Woodard if he left information out of his police report.
Woodward testified that during negotiations Kenneth Tipton told police that they had no right to enter his home because they did not have a search warrant.
He also testified that TIpton told negotiators that he never intended to hurt anyone and that when he did surrender he apologized for his actions.
Callahan wanted the jurors to hear the information because it was not included in Woodard's police report, but Lawrence County Deputy Prosecutor Tim Sledd objected and Judge William Sleva agreed the jury could not hear the testimony.
Testimony continues today.
