Man Pleas Guilty In Bloomfield Court

(BLOOMFIELD) - A rural Jasonville man, originally charged with two felony battery charges and a resisting law enforcement count, entered into a negotiated plea agreement that set him free from jail following a hearing in Greene Superior Court on Tuesday morning.

48-year-old Brian W. Worth, entered into a negotiated plea agreement in Greene Superior Court Tuesday morning. Worth said he was guilty of possession of marijuana and carrying a handgun without a permit - both Class A misdemeanors.

In exchange for his guilty pleas, the prosecution agreed to drop two charges of battery committed by means of a deadly weapon or resulting in serious bodily injury, both Class C felonies; resisting law enforcement, a Class A misdemeanor; and possession of marijuana with a prior conviction, a Class D felony.

Judge Dena Martin sentenced him a concurrent sentence of one year in the Greene County Jail with all but 234 days suspended. Worth was given credit for 117 days served -- meaning his jail term was satisfied Tuesday.

Worth was also ordered to serve one year of supervised probation, fined $50 and court costs, probation fees and ordered to complete a drug and alcohol assessment.

In addition, a non-contact order with his brother, Dana Worth, was issued and a .22 caliber Phoenix semi-automatic handgun was forfeited to the county sheriff's department.

All of the charges resulted from an altercation April 14 in which Brian Worth allegedly pistol-whipped his brother, Dana Worth, before shooting him once in the hand.

Police said Dana Worth attempted to defend himself against the attack from his brother with a baseball bat.

However, Brian Worth's attorney said it was his client who was trying to defend himself from an attack by Dana Worth with a baseball bat when the shots were fired from the handgun.
