(BLOOMFIELD) - Eighteen-year-old Maclyn Booher, of Dugger, was arrested Monday for dealing in marijuana over 30 grams, according to Greene County Drug Task Force officers.
He entered a not-guilty plea Monday afternoon in Greene County Circuit Court.
Judge Erik Allen set a pre-trial conference for 8:30 a.m. on Feb. 8, 2012 and a trial by jury at 9 a.m. on Feb. 28, 2012. He appointed Jim Reister as Booher's public defender.
On Sept. 16, members of the Drug Task Force worked in cooperation with a confidential informant (CI) to make a purchase of a quarter ounce of marijuana from Booher for $100. The serial numbers on the cash, supplied to the CI by police, had been pre-recorded. The CI was also provided with a digital recording device to gather evidence from the buy, according to the probable cause affidavit.
The buy took place when Booher arrived as a passenger in a red pickup driven by Jared Sargent at about 9:19 p.m. A few minutes later, the CI exited the truck and walked back to the undercover police vehicle with two plastic bags that contained marijuana.
The CI set up a second controlled buy from Booher on Oct. 7 in a local parking lot. The CI was dropped off at the location and a short time later Booher arrived in a vehicle with a female passenger.
Booher and the CI talked and then Booher left to go pick up some marijuana, according to the affidavit.
A short time later, Booher returned and provided the CI with about two ounces of marijuana for $265, which was paid with mark money the police provided.
Booher posted $4,000 bond and was released from jail on Sept. 10 on this case. However, Booher faces other legal problems.
He was arrested Monday and returned to jail, on a petition to revoke a suspended sentence handed down in Greene Superior Court for a May 11 conviction of battery.
Superior Court Judge Dena Martin sentenced Booher to 180 days in jail and suspended all but two days.
