Boy To Be Tried As Juvenile In 6-Year-Old's Murder

Last updated on Tuesday, July 19, 2011

(MARTINSVILLE, IN) - The 11-year-old boy accused in the murder of his 6-year-old brother will be tried in juvenile court.

Morgan County Prosecutor Steve Sonnega says many factors went into the decision, including the possibility of rehabilitation, and he feels the boy is not beyond being rehabilitated.

Sonnega says they also looked at the boy's age maturity and cognitive ability, along with his situation at home.

Sonnega says he is looking into the possibility of charges against the mother concerning storage of the gun, but no decision has been made.

6-year-old Andrew Frye was fatally shot June 30th in Martinsville.

The 11-year-old is being held at the Johnson County Juvenile Detention Facility.

A fact-finding hearing in the case is scheduled for next week.
