(MARTINSVILLE, IN) - The 11-year-old Martinsville boy accused of shooting his 6-year-old brother will make his first court appearance today.
The initial court hearing will be held this afternoon at 2:00PM at the Morgan County Courthouse.
He's facing charges of murder and criminal recklessness after he allegedly shot his brother, 6-year-old Andrew Frye, last Thursday.
The boy initially told police that he found his brother in the bathroom after hearing a loud pop. He was taken into custody the following day.
The children's parents were not home at the time of the shooting but a local ordinance says a child over the age of ten is allowed to babysit.
The evidence against the boy has been sealed because he's a juvenile but Morgan County Prosecutor Steve Sonnega says for a murder charge, they have to have evidence that the act was knowing or intentional.
The judge will determine if the boy will be waived into adult court.
