Obama's Supreme Court Nominee Draws Concern

Last updated on Tuesday, May 11, 2010

(BLOOMINGTON, IN) - President Obama’s second Supreme Court nominee may be hard to pigeonhole.

Solicitor General Elena Kagan also worked in the Clinton White House, for Michael Dukakis's unsuccessful 1988 presidential campaign, and in the senate for Vice President Biden.

But because she's never been a judge, there's no paper trail suggesting how she'd rule on specific issues.

Indiana University Law Professor Patrick Baude says she may prove unpredictable, much like the justice she'd replace, John Paul Stevens.
