Court Of Appeals Overturns Brown County Fire District Dissolution

(NASHVILLE, IN) - The Indiana Court of Appeals has reversed the Brown County Commissioners January 2009 decision to dissolve the Brown County Fire District.

The Fire District was essentially a loose affiliation with other fire departments that share resources, training and other items in an effort to better serve the residents and businesses in the area.

The court says the commissioners do not have the authority to make such a decision by ordinance alone.

The ruling late last week lays out the steps legally required to dissolve a fire district, which includes landowners petitions and public hearings.

Brown County resident and Attorney Bill Lloyd who filed the initial suit against the commissioners says he is very pleased with the ruling.

He noted the ruling provides future guidance for those communities who find themselves in situations similar to those in Brown County.

Lloyd says the county's fire district has been the subject of court hearings in the past.
