(MUNCIE) - An appeal over the shooting death of Bedford native Michael McKinney by a Ball State University police officer may be coming to a us district court near you.
According to the Ball State University student newspaper, the Daily News, a motion for appeal has been filed by the McKinney family, and a response was entered early last month by defense attorneys and, so far, the presiding judge hasn't made a decision as to whether or not he will grant a new trial.
What is apparently certain, so far, is that Ball State has dropped some serious coin on defending former campus officer Robert Duplain.
The bill so far, according to the Daily News is $1.3 million, although all but $100,000 of that will be taken care of by insurance.
All this stems from when officer Robert Duplain shot and killed Michael McKinney, a senior from Bedford, in 2003.
No criminal charges were filed against Duplain, and in early February of this year, Duplain was found not to be liable for the death of McKinney in a $275 million lawsuit brought by the family.
