Hembree Found Not Guilty

(PAOLI) - An Orange County jury has found an Orleans man not guilty in the death of his six-month daughter.

The jury deliberated for almost five hours before returning their verdict Tuesday night. 26-year-old James "Jay" Hembree was charged with battery resulting in death in connection with the September 2005 death of six-month old Lexi Hembree.

The jury heard seven days of testimony that included several expert medical witnesses and the defendant himself. Prosecutor Kelly Minton said the evidence pointed to Hembree being responsible for his daughter's death.

Defense attorney Nick Herthel told jurors everyone that testified said his client was a good father and no one ever saw him hit or abuse his daughter.
