(INDIANAPOLIS) - Republican presidential nominee John McCain says even a point of agreement with Barack Obama points out the differences between them.

McCain and Obama have criticized last week's supreme court ruling throwing out the death penalty for child rapists. In a speech in Indianapolis to the National Sheriffs' Association, McCain noted Obama voted against the confirmation of two of the dissenting justices, John Roberts and Samuel Alito.

He says the majority justices are a preview of what an "Obama court" would look like.

However, that could be an unfair judgment, since Senate records show McCain voted for 4 of the 5 in the majority opinion.

As a matter of fact, the only justices McCain has not voted for are John Paul Stevens and Antonin Scalia, and that was because they were confirmed before he was elected to the senate.
