Bookstores Challenging "Sexually Explicit" Material Law

(UNDATED) - It was signed into law by Governor Mitch Daniels in the spring and now it’s the subject of a lawsuit.

The American Civil Liberties Union and several booksellers groups are suing the state over a new law that requires businesses that sell "sexually explicit" material to register with the state. The law is set to take effect July 1st and would mean a $250 registration fee for Hoosier booksellers.

Liz Barden runs Big Hat Books in Broad Ripple and calls the law "disappointing." She also says this could close booksellers across the state.

Barden says this is not about adult bookstores, but about the first amendment being infringed upon. Violations of the new law carry fines and possible jail time.
