(LAFAYETTE) - A former Tippecanoe County sheriff’s deputy and several county agencies are facing a wrongful death lawsuit stemming from the Aiyana Gauvin case.

The mother and grandparents of the four-year old are seeking an unspecified amount of money for injuries and damages she suffered.

The girl's stepmother, Michelle Gauvin, is serving life in prison for the 2005 murder. The father, Christian Gauvin, was sentenced to 50-years for neglect of a dependent. Both are also named as defendants in this case.

The lawsuit claims former deputy Glen Keller failed to properly investigate an abuse call at the Gauvin home in 2004. He has since resigned and pleaded guilty to perjury for lying in a deposition about his investigation.

Tippecanoe County Child Protective Services and the Division of Family and Children are also accused of not protecting Aiyana. County Attorney Dave Luhman says he has seen the lawsuit, but has not discussed it fully with county officials.
